Terms & Conditions
These Terms & Conditions ("Terms") govern your use of Dad Stretch Club (the "Service"), operated by Ben Jolliffe ("we", "us", "our"). By signing up for the Service or continuing to use it, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
Dad Stretch Club is a subscription SMS service that sends one text message per day with a link to a short guided stretching routine. You may adjust your send time, pause the daily text, or unsubscribe at any time. You must be of legal age in your jurisdiction to enter into a binding contract, and you confirm that the phone number you provide is one you are authorized to use.
2. Free trial and membership
New signups receive a 7-day free trial. After the trial, continued access to the daily text requires an active paid membership at $1 per week, billed weekly, cancellable at any time. Detailed payment, billing, tax, cancellation, and refund mechanics are governed by our reseller Paddle — see section 4.
3. Acceptable use
You agree not to:
- use the Service for any unlawful, fraudulent, or abusive purpose;
- submit a phone number you do not own or are not authorized to use;
- attempt to interfere with, probe, scrape, reverse-engineer, or otherwise compromise the Service or its underlying systems;
- use the Service to send spam or infringe anyone else's rights.
4. Payments — Paddle as Merchant of Record
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment terms, billing, tax, cancellation, and refund mechanics are governed by the Paddle Checkout Buyer Terms. You can manage or cancel your membership at any time from the Manage page linked in your daily text.
5. Intellectual property
The Service, including its software, text, guided routines, audio, branding, and design, is owned by Ben Jolliffe and is protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable right to use the Service for personal, non-commercial purposes while your subscription is active. You may not resell, redistribute, or create derivative works from the content of the Service without prior written consent.
6. Health disclaimer
The Service provides general fitness information for healthy adults. It is not medical advice. Consult a qualified healthcare professional before starting any new exercise program, especially if you have an injury, medical condition, or concerns about physical activity. You use the Service at your own risk.
7. Service availability
We do our best to keep the Service running reliably, but we do not guarantee that it will be uninterrupted, timely, secure, or error-free. Text message delivery depends on carriers and other third parties outside our control.
8. Suspension and termination
We may suspend or terminate your access to the Service at any time, without refund of the current billing period beyond what is required by our Refund Policy or Paddle's refund handling, if we reasonably believe you have materially breached these Terms, failed to pay, or created a security or fraud risk, or if you have repeatedly or seriously violated our policies. You may stop the Service at any time by unsubscribing or canceling your membership.
9. Disclaimers and liability
To the fullest extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. To the fullest extent permitted by law, our total liability to you for any claim arising out of or relating to the Service is limited to the amount you paid us in the twelve months preceding the claim. We are not liable for indirect, incidental, consequential, or special damages, including loss of profits, data, or goodwill. Nothing in these Terms limits liability that cannot be excluded by law.
10. Changes
We may update these Terms from time to time. Material changes will be reflected by updating the date at the top of this page. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
